Be it Remembered That heretofore, to-wit, on the 23rd., day of January A.D. 1913, was filed in the Probate Court of Pike County, Ohio, an instrument purporting to be The Last Will and Testament of Harvey Pancake, Deceased, which said Will is in the Words and Figures as follows, to-wit:-
Last Will and Testament of Harvey Pancake.
In the name of the Benevolent Father of All: I, Harvey Pancake of Omega, Pike County, Ohio, being of sound mind and judgement and knowing that life is uncertain and that death is sure, do make and publish this my last will and testament, revoking all former wills by me previously made.
Item 1st. I hereby direct that all my just debts and funeral expenses be paid.
Item 2nd., It is my will that after my death my wife, Malinda Pancake, is to have, absolutely, all my personal property of whatsoever kind and character, and consisting principally of household goods, bed and bedding.
Item 3rd., I have sold my farm in Jackson township, Pike County, Ohio, to Charles E. Hemmerle, for which the said Charles E. Hemmerle is to pay me the sum of three hundred ($300.00) dollars per year during my lifetime, and the said Charles E. Hemmerle is also to pay the taxes on said land, now: should any part of the said three hundred dollars ($300.00) remain unpaid at the time of my death, I give and bequeath the same to my wife Malinda Pancake, absolutely for her sole benefit:
Item 4th: I am the owner and possessor of one burial lot in the cemetery at Omega, Ohio, in which I desire to be buried by the side of my first wife and I also desire that my present wife Malinda Pancake, shall be buried in said lot, if she so desires, but no other person to be buried thereon:

Signed sealed and acknowledged as the last will and testament of Harvey Pancake, in the presence of David J. Wickline and C.L. Washburn and by us subscribed in his presence and in the presence of each other this the 2" day of May, 1908.

to admit to Probate which said Application is in words and figures as follows, to-wit:-

To the Probate Court of said County
Your petitioner respectfully represents that Harvey Pancake late a resident of the township of Jackson in said County, died on or about the 20th., day of November A.D. 1912, leaving an instrument in writing, herewith produced purporting to be his last Will and Testament:
That the said Harvey Pancake died leaving Malinda Pancake his widow who resides at Omega,
Ohio and the following named persons his only next of kin, to-wit:

Whereupon on said 23rd., day of January A.D. 1913 was made by said Probate Court an order, which said order is in words and figures as follows, to-wit:-

and Testament of Harvey Pancake : Will and Application to Probate
Deceased :
This day an instrument of writing, purporting to be the last will and testament of Harvey Pancake, late of Jackson Township, in this County, deceased, was produced in open court for probate.
It is now ordered that the said Will be filed in this court and that due notice thereof, and of the application to admit the same to probate and record, be given to the widow and next of kin of the testator, resident of the State of Ohio, and that said application will be for hearing before this Court, on the 25th., day of February, 1913 at One o'clock P.M.
