State of Ohio vs. Absalom Pancake
(Assault and Battery)
Pleas held at the Court house in the Town of Piketon in and for the County of Pike before the Honorable John Thompson, President Judge of the Court of Common Pleas for the Second Circuit of the State of Ohio; Samuel Henry, Enos Prather and Samuel Reed esquires, associate Judges of our said Court, on the thirtieth day of March, in the year of our Lord one thousand eight hundred and eighteen and in the year of the State the sixteenth.
Be it remembered that heretofore to wit, at the Term of November in the of our Lord one
thousand eight hundred and seventeen, John Barnes, Foreman, Joseph Boiler, John Chenowith,
Daniel Rodrick, Allen Barnes, William Parker, Samuel (-ink blot-), William Acton, William
Bridges, Abraham Bennett, John Measny(?), Joseph Polby, Benjamin Daniels, Reuben Stavens(?),
and Thomas Beavers was empannelled Sworn and Charged as a Grand Jury of Inquest for the
Body of Pike County, who upon their Oath found the following Indictment which reads in the
words and figures following, to wit. State of Ohio Pike County Court of Common Pleas of the
Term of November, in the year of our Lord one thousand eight hundred and seventeen. Pike
County /// the Grand Jury of the State of Ohio empannelled and sworn to inquire of crimes and
offences committed within the body of Pike County aforesaid in the name and Authority of the
State of Ohio aforesaid upon their Oath present that Absalom Pancake late of Pike County
aforesaid (illegible) on the tenth day of April in the year of our Lord one thousand eight hundred
and seventeen with force and Arms at the Township of Pee Pee in the County aforesaid , and
within the Jurisdiction of this Court in and upon one Thomas Wallace in the publick peace then
and there being unlawfully did make an assault and him the same Thomas Wallace did then and
there strick beat and ill treat, contrary to the Statute in such case made and provided and against
the peace and dignity of the State of Ohio. Joseph Sill prosecuting attorney for Pike County.
Witness William Bridges -- And afterwards towit, on the thirteenth day of December in the year
of our Lord one thousand eight hundred and seventeen Joseph Sill esquire prosecuting attorney
for Pike County issued out of the Clark's office of our said Court our Writ of (Caping orders
ponder?) down(?) in the above indictment which writ and the sheriff's return reads as followeth
towit, The State of Ohio Pike County /// to the sheriff of Pike County Greetings. We command
you to take Absalom Pancake if he be found within your Bailiwick and him safely keep so that
you have his body before the Jurors of our Court of Common Pleas for the County aforesaid on
the first day of our next Term, to answer unto the State of Ohio of a Certain Indictment and This
he shall in no wise Omit -- and have then there this Writ. Witnesseth the Honorable John
Thompson President Judge of our (Com. pleas Seal) said Court this 13th day of December 1817
and in the year of this State the sixteenth. Joseph Martin Clerk -- And now at this day towit at
the day in the year and at the place first herein written Came the prosecuting attorney in behalf the
State and the defendant in his own proper person and being forthwith demanded concerning the
premises in the above Indictment Plead thereto guilty. After mature Consideration it is the
sentence of the Court that for such his offence he make his fine to the State of Ohio by the
payment of four dollars and the Costs of his prosecution and may be taken. ///
NB: I have never found any other record of Absalom Pancake.
